Perhaps you were grandfathered in under a previous Sonic policy. I asked 
them about modem rental in October and received this reply:

"Things have changed a bit over the course of the short life of our 
modem rental program so far, but the current policy is: upgrading from 
Legacy DSL to Fusion requires that you rent the modem."
