[1] By which I mean covered by patents enforced in a problematic
fashion, e.g., Fraunhofer Institute / Thomson Consumer Electronics's
insisting on royalty payments for MP3 encoders and decoders.  It's
eminently possible to create open-source / free MP3 players, but the
rights characteristic of open-source software are not fully available to
citizens of many countries because of the patent-litigation threat.
(Those particular patents will expire in April 2010.)
