Quoting Howard Susman (hsusman at scsurplus.com):
> I was sued for ADA noncompliance. After considerable expense, I
> hope I am now compliant. The plaintiff has filed many suits.
> Indeed, in my case, he referred to my business as a restaurant which
> it is not.
I hope you won't mind my laughing at that bit, Howard (certainly not
_at_ you or the irritation of dealing with such things).
What I gather from a quick read-up on this subject is that the serial
ADA plaintiffs have turned the cranking out of lawsuits into a heavily
templated business. Their law firms re-use the same complaint language
over and over -- so probably they just copied-and-pasted a complaint
used against restaurants to file against your surplus business without
noticing their unintentional comedy.
Unfortunately, the suit cannot be dismissed just because plaintiff
phoned it in and failed to describe the target business correctly.
Steven's Creek Surplus, worth a visit if you are in San Jose!
