What are the consequences if the universities won't comply?
What would be considered best effort to comply?

Where should the right boundary between economically reasonable and fair be?

I think that in the era we are living in fortunately the conflicts 
between economically reasonable and fair are very few and most of the 
time we're doing the economy wrong.

Before complaining to the DOJ I'd think where is the right place to 
complain about spending some public money eg. in keeping US nuclear 
arsenal 'top of the pack'.
