Two brief points:  1.  There is a absolutely nothing wrong with CDDL as a
weak-copyleft reciprocal licence.  It's definitively open source / free,
and even FSF has no problem with it.

2.  Linus is a decent coder and very good project manager but has no
real qualifications as a filesystem designer -- which is why he wisely
leaves that tasks to others such as Ted Ts'o and Chris Mason.
